Terms of Service — PumpBuild

Important Notice on Non-Custodial Software Architecture:

PumpBuild operates strictly as a decentralized, non-custodial web interface and software tool. PumpBuild does not act as a broker, custodian, exchange, or financial advisor. All transactions are initiated, signed, and broadcast directly by you via your non-custodial wallet.

1. General Information

These Terms of Service (“Terms”) govern your access to and use of the PumpBuild website (the “Website”), web applications, software, tools, and smart contract interfaces (collectively, the “Service” or “PumpBuild”).

PumpBuild operates as a decentralized, non-custodial web interface designed to facilitate the creation and deployment of SPL tokens on the Solana blockchain, integration with the Pump.fun bonding curve protocol, and automated generation of dedicated project landing pages (/t/[mint]).

PumpBuild is strictly a frontend software interface and does not act as a broker, dealer, exchange, custodian, investment advisor, asset manager, or financial institution. PumpBuild does not hold custody of, control, send, or receive user funds, private keys, or digital assets. All transactions are initiated, signed, and broadcast directly by you via non-custodial Web3 wallet software (e.g., Phantom, Solflare, Backpack).

By accessing the Website, connecting your digital wallet, or using any feature of the Service, you irrevocably agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must immediately cease accessing and using the Service.

2. Decentralized Architecture & Non-Custodial Nature

PumpBuild provides software tools that streamline blockchain interactions. You acknowledge and understand that:

  • Self-Custody: You retain sole responsibility for safeguarding your wallet credentials, private keys, and seed phrases. PumpBuild has no access to your wallet and cannot recover funds under any circumstances.
  • Direct Execution: Every action (including token minting, security authority revocation, and token purchases) is executed directly on the Solana blockchain by your wallet through autonomous smart contracts.

3. User Acknowledgements & Protocol Risks

All token deployments and transactions are conducted on the Solana network (Mainnet-Beta or Devnet). PumpBuild relies on independent third-party networks, protocols, and decentralized infrastructure:

  • Solana Network & RPC Infrastructure: PumpBuild is independent and not affiliated with the Solana Foundation. We do not guarantee continuous network uptime, transaction throughput, or node response times. Network congestion, micro-forks, or RPC node failures may cause delayed or failed transactions.
  • Pump.fun Bonding Curve Protocol: Initial liquidity, algorithmic token pricing, and bonding curve mechanisms are powered entirely by autonomous Pump.fun smart contracts. PumpBuild does not own, manage, modify, or control the Pump.fun protocol, its bonding curve parameters, or its automated liquidity migration to Raydium.
  • Third-Party Storage & Indexers: Token metadata and visual assets are uploaded to decentralized storage (IPFS/Pinata), and real-time market data is provided by external indexers (such as DexScreener). PumpBuild is not liable for third-party service outages or data inaccuracies.

You acknowledge that trading and deploying memecoins involves extreme market risk, rapid price volatility, and the potential loss of all invested capital. Blockchain transactions are immutable, final, and irreversible once confirmed.

4. Platform Fees & Payment Terms

  • Service Creation Fee: Deployment of an SPL token and hosting of its companion landing page requires payment of a base protocol service fee (denominated in SOL), along with supplemental fees for optional security configurations (e.g., Revoking Mint Authority, Revoking Freeze Authority, or making Metadata Immutable).
  • Initial Creator Buy (Dev Snipe): If you opt to purchase a starting allocation of your token during the deployment transaction, a protocol allocation fee (1% of the total Dev Snipe amount) is automatically deducted and routed to the platform treasury.
  • Non-Refundable Transactions: All network transaction fees (Solana Gas/Priority Fees), account rent fees, and platform service charges are completely non-refundable, regardless of whether a token succeeds, fails, or experiences adverse market conditions.

5. Eligibility & Prohibited Jurisdictions

To access or use PumpBuild, you represent and warrant that:

  • You are of legal age in your jurisdiction (at least 18 years old or the age of majority).
  • Your use of the Service complies with all local laws, rules, and regulations applicable to you.
  • You are not a citizen, resident, or agent of, nor are you located in, any country or territory subject to comprehensive sanctions or trade embargoes administered by the U.S. Office of Foreign Assets Control (OFAC), the European Union, the United Kingdom, or the United Nations.
  • You will not utilize the Service to execute fraudulent schemes, exploit backdoors, fraudulent liquidity drains, wash trading, unauthorized securities offerings, money laundering, terrorist financing, or any other unlawful activity.

6. User Content & Token Metadata Responsibility

You bear sole legal and financial responsibility for all metadata and assets submitted through the Service, including:

  • Token names, symbols/tickers, and background descriptions (Lore);
  • Uploaded artwork, generated mascots, and media assets;
  • External links to social channels (Telegram, X/Twitter, websites).

You warrant that your submitted content does not violate any third-party intellectual property rights, trademarks, or copyrights, and does not contain defamatory, obscene, malicious, or unlawful material. PumpBuild reserves the right, without prior notice, to delist, conceal, or restrict public access to any landing page (/t/[mint]) or catalog listing associated with malicious activity, copyright infringement, or illegal behavior.

7. No Financial or Investment Advice

All features on the Website—including trend analysis tools, AI generators, and market previews—are provided strictly for informational and entertainment purposes. Nothing published by or contained within PumpBuild constitutes:

  • Financial, investment, trading, accounting, or legal advice;
  • An offer, solicitation, or recommendation to buy, sell, or hold any digital asset or security;
  • A guarantee of token liquidity, market adoption, or price appreciation.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory.

8. Intellectual Property Rights

PumpBuild and its licensors retain all rights, title, and interest in and to the platform’s proprietary software, website design, UI layout templates, logos, brand elements, and underlying frontend architecture. You may not copy, reverse engineer, scrape, decompile, or commercially exploit PumpBuild’s proprietary software or design system without explicit prior written authorization.

9. Limitation of Liability

To the maximum extent permitted by applicable law, PumpBuild, its contributors, affiliates, and operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of digital assets, profits, capital, or anticipated economic gains;
  • User errors, such as mistyped addresses, incorrect slippage settings, or compromised private keys;
  • Vulnerabilities, bugs, hacks, or exploits within third-party smart contracts (Solana runtime, SPL Token program, Pump.fun, or Raydium);
  • Disruptions, downtime, or network halts affecting the Solana blockchain or third-party RPC providers.

10. Modifications to Terms

PumpBuild reserves the right, in its sole discretion, to modify or update these Terms at any time. When updates are published, the “Last Updated” date at the top of this document will be amended accordingly. Your continued access to or use of the Service following any revisions constitutes full acceptance of the updated Terms.
